WHO WE ARE
These Terms of Service (“Terms”) govern your access to and use of services provided by Empire Notary — Legal Tender NJ, LLC (“Empire Notary,” “we,” “us,” or “our”), including mobile notarization, Remote Online Notarization (“RON”), Apostille Concierge, corporate/business notarization, loan signings, bedside notarization, group events (Notary Fair), witnesses, scanbacks, courier/hand-delivery, scheduling, website, and related communications.
ACCEPTANCE OF TERMS
By booking, paying for, or receiving our services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use our services.
NO LEGAL ADVICE; NOTARY ROLE
We are not a law firm and do not provide legal advice. Our role is limited to performing notarial acts permitted by law and providing related logistics (e.g., shipping, scanbacks, appointment coordination). You are responsible for the legal sufficiency of your document and whether a notarial act is appropriate or required.
CLIENT RESPONSIBILITIES
a) Identity & Capacity: Present valid, unexpired government photo ID; you must have capacity and willingness to sign.
b) Document Readiness: Documents must be complete but unsigned when the session begins (jurats/witnessing require signing in our presence). Remove blanks or mark “N/A.”
c) Recipient Acceptance (RON vs. wet-ink): You must verify acceptance with your recipient (court, bank, title/escrow, agency, school, etc.). Many still require wet-ink notarization. If RON is not accepted, we may convert to mobile/wet-ink at the applicable rate.
d) Witnesses: You must confirm whether witnesses are required and any disqualification rules. If we supply witnesses, they must be disinterested and legally eligible; availability is not guaranteed.
e) Technology (RON): You must have adequate device, browser, camera/mic, lighting, and stable internet; you must complete KBA/credential analysis within the platform’s allowed attempts.
SCHEDULING; ARRIVAL; WAIT TIME
a) Start Times: Appointments start at the scheduled time. Please join/arrive 5 minutes early.
b) After-Hours: After-Hours access is available 7:00 PM–2:30 AM and carries published premiums.
c) Travel & Non-Refundable Start: Distance-based travel fees apply and are non-refundable once travel begins. Parking/tolls are billed at cost with receipt.
d) Wait Time: A 10-minute grace period is included. Thereafter, wait time may be billed per our current price list.
FEES; PAYMENTS; ADD-ONS; ADMIN FEES
a) Pricing: Current prices are listed on our website/booking system and may change without notice until booked/paid. Changes to scope (e.g., additional notarized signatures, witnesses, long-distance travel, rush handling, scanbacks, carrier drop-off) incur additional fees.
b) Payment & Authorization: Payment is due at booking unless otherwise stated. By submitting a payment method, you authorize us to charge all fees, add-ons, travel, parking/tolls, printing, and approved overages.
c) Refund Processing: When a refund is approved under our policies, it may be reduced by a 5% administrative processing fee to cover third-party payment costs and scheduling time.
d) Chargebacks: Unfounded chargebacks will be contested and may incur a $50 dispute administration feeplus recovery of processor penalties and reasonable collection costs.
e) Late Balances: Unpaid invoices accrue 1.5% per month (18% APR) or the maximum permitted by law, whichever is lower. You agree to pay reasonable collection costs, including attorneys’ fees.
REMOTE ONLINE NOTARIZATION (RON)
a) Recording & ID Proofing: RON requires audio/video recording and ID proofing (KBA and/or credential analysis). You consent to these processes and retention for the period required by law/platform policy.
b) One Signature Included: Unless stated otherwise, a RON session includes one notarized signature. Additional notarized signatures may be billed as add-ons.
c) Platform & Failures: RON is performed under New Jersey law using authorized platforms. Platform or connectivity failures may require rescheduling or conversion to mobile/wet-ink at the applicable rate; platform/time costs already incurred may remain due.
MOBILE / IN-PERSON NOTARIZATION
a) Location, Access & Safety: You are responsible for providing a safe, lawful location and any access/parking instructions.
b) Bedside/Medical: We must verify identity and willingness without coercion. If capacity cannot be verified, we must refuse; applicable fees (travel/time) may remain due.
APOSTILLE CONCIERGE
a) Scope (All-In): Our All-In tiers (Standard or Premier) for one document include review, notarization if required and accepted (RON or local mobile ≤10 miles), the state apostille fee, submission/tracking, and domestic return shipping.
b) Timelines: Timeframes (e.g., 7–10 or 3–5 business days) are targets measured after we receive ready documents and required approvals. Government/courier delays are outside our control and are not grounds for refund.
c) Vital Records: Many destinations require certified vital records; you are responsible for obtaining them from the issuing agency unless explicitly included.
d) International Shipping & Legalization: International return shipping and embassy/legalization (if required) are quoted separately and are non-refundable once ordered.
e) Designated Agent: You authorize us/our agents to submit documents and interact with government offices/couriers to complete your Apostille request.
REFUSAL / INABILITY TO PERFORM
We must refuse or stop a notarization if identity cannot be verified, the document is incomplete/unlawful, capacity/willingness is in doubt, the act is prohibited, or the environment is unsafe. Fees already incurred (e.g., travel, platform, time) may remain due.
INTELLECTUAL PROPERTY; SITE USE
Our website, brand, text, images, and materials are owned by us or our licensors and protected by law. You may not copy, modify, or use our content except to evaluate/book services.
THIRD-PARTY SERVICES
We use third-party providers (RON platforms, ID/KBA vendors, payment processors, couriers, scheduling/email tools). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party sites/services we do not control.
DISCLAIMER OF WARRANTIES
Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee recipient acceptance, government processing times, courier performance, platform availability, or particular outcomes.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the services or these Terms shall not exceed the amount you paid for the specific service at issue. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages (including delay, denial of acceptance, lost profits, lost data, or government/courier/platform actions), even if advised of the possibility.
INDEMNIFICATION
You shall defend, indemnify, and hold harmless Empire Notary and our owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (i) your documents, content, or instructions; (ii) your failure to verify recipient acceptance or witness requirements; (iii) your breach of these Terms or law; or (iv) third-party claims related to your transaction.
FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control, including government closures, statutory or policy changes, platform outages, carrier delays, severe weather, acts of God, labor actions, emergencies, or similar events.
DISPUTE RESOLUTION (BINDING ARBITRATION; CLASS ACTION WAIVER)
Any dispute arising out of or relating to these Terms or the services shall be resolved by binding arbitrationadministered by the American Arbitration Association under its Commercial Rules in Essex County, New Jersey. You and we waive any right to a jury trial and to participate in a class or representative action.Either party may seek temporary injunctive relief in a New Jersey court of competent jurisdiction to preserve the status quo.
CHANGES TO SERVICES AND TERMS
We may modify services, pricing, and these Terms at any time. The Effective Date indicates the latest version. Continued use after changes constitutes acceptance.
GOVERNING LAW; VENUE
These Terms are governed by the laws of the State of New Jersey and applicable U.S. federal law, without regard to conflicts principles. Venue for any permitted court action lies exclusively in state or federal courts in New Jersey.
SEVERABILITY; WAIVER; ENTIRE AGREEMENT
If any provision is held invalid, the remaining provisions remain in full force. Waiver of any term on one occasion is not a waiver on any other occasion. These Terms, the Privacy Policy, and any service-specific confirmation (invoice, booking, written quote) constitute the entire agreement.
